Debt Collection Agreement and the Debt Collector’s Invitation to Continue Collecting
As of today, we can say that Chapman Financial Services, Inc., has filed a federal lawsuit against a woman in the state of Utah for breach of contract, breach of fiduciary duty, and unjust enrichment. The case was filed by a debt collection agency that is a division of H&R Block.

According to the Federal Trade Commission, Chapman Financial Services, Inc., has a “robust and extensive” business portfolio. The company also provides financial advising and provides advice on estate planning, life insurance, business formation, and general banking services.
Federal Trade Commission Complaint: This complaint relates to an incident in which a debtor contacted Chapman Financial Services, Inc., and requested assistance with debt collection. According to this report, a representative from the company called the debtor and advised her that the case had been assigned to them by Mountain Star PamL.
According to this report, the representative informed the debtor that Mountain Star PamL was the client, and that her debt was owed to Mountain Star PamL. In a follow-up meeting, this debtor stated that Mountain Star PamL was not the client of Chapman Financial Services, Inc., but explained that she was actually working for Mountain Star PamL as an independent contractor. She stated that she owed the debt to Mountain Star PamL and could not contact Mountain Star PamL in any regard. According to this report, a representative of the company told her that Mountain Star PamL would be contacting Mountain Star PamL if she did not get in contact with them in a reasonable amount of time.
According to this report, this company representative told her that she would not have to contact Mountain Star PamL because they were the clients of Chapman Financial Services, Inc.. When the debt collector reached Mountain Star PamL about this matter, this debt collector said that if she would not get in contact with them then Chapman Financial Services, Inc., would call Mountain StarL. to collect on behalf of the debtor.
According to this report, the debt collector proceeded to call Mountain Star on behalf of the debtor, and explained that the company was only collecting money owed to Mountain Star. and did not own the debt. When the debtor attempted to object, the debt collector stated that she was obligated to the debt collectors if Mountain Star purchased the debt and threatened that Mountain Star would send a collection attorney to collect on her behalf.
According to this report, a debt collector also instructed the debtor’s phone number to be disconnected. This action resulted in the debt collector not being paid and Mountain Star gets the debt owed to Mountain Star PamL and the collection agent did not receive any payment from Chapman Financial Services, Inc., despite the fact that the company claimed that it was owed by Mountain Star PamL.
A representative of Mountain Star Legal Services told this same debt collector that Mountain Star did not sell debt collection accounts, and that Mountain Star only sells accounts that are in default or have been purchased from a third party. A representative of Mountain Star Legal Services indicated that the company does not sell accounts to any third party because those accounts would not be sold on a regular basis and the debt collector was obligated to pay for the account if it was not sold to another third party. According to this report, this debt collector made several attempts to return the debt collector’s phone calls and the debt collector made repeated attempts to talk to Mountain Star Legal Services on behalf of the debtor, who told the debt collector not to contact Mountain Star.
According to this report, after a series of attempts to return calls and the debt collector continually made attempts to call Mountain Star, the debt collector stated that she did not have to talk to Mountain Star Legal Services on behalf of the debtor. After the debt collector said that she did not have to speak to Mountain Star Legal Services on behalf of the debtor, the debt collector made three attempts to call Mountain Star Legal Services and the debt collector received no response from Mountain Star Legal Services.
According to this report, a representative of Mountain Star Legal Services indicated that the debt collector is not permitted to contact Mountain Star and stated that if the debt collector wanted information about the debtor she would contact the company through the toll free number, provided she had a copy of the debt collection agreement. When the debt collector requested the name of Mountain Star, the representative of Mountain Star Legal Services stated that Mountain Star Legal Services would not provide such information to the debt collector unless she received a written acknowledgment form from Mountain Star Legal Services, which she did not receive.
According to this report, according to this representative of Mountain Star Legal Services, the debt collector has received multiple calls from the debt collector. and the debt collector is not currently making any attempts to contact the debtor.
